HAMBY United Carrier Agreement

Dispatch Fee Acknowledgment

HAMBY United charges an 8% dispatch fee on loads booked and dispatched on the carrier's behalf. Carriers may optionally add billing and invoicing services for an additional 2%. With or without the optional billing service, the maximum total fee will never exceed 10%.

Acknowledgment of Dispatch Fee

By typing my full legal name below, I acknowledge that I have read, understood, and agree that HAMBY United charges an 8% dispatch service fee on loads booked and dispatched by HAMBY United, with an optional additional 2% for billing and invoicing services, for a maximum total fee of 10%.

Acknowledgment of First Load On Us Promotion

By typing my full legal name below, I acknowledge that I have read, understood, and agree to the First Load On Us promotion. I understand that the first load is free only if I continue with HAMBY United for the next two subsequent loads after this agreement is approved. After those three total loads, there is no long-term contract or forced obligation to continue service.

⚠ Reminder

This is not a long-term contractual obligation. The only obligated hauls arranged by HAMBY United will be the first approved haul after this agreement is approved and the next two subsequent hauls after that.

Section 06

Carrier Operating Agreement

HAMBY United agrees to assist the carrier with dispatch support, load search, load communication, and related administrative support based on the information provided by the carrier.

The carrier understands that HAMBY United acts as a dispatching support service and does not take ownership of the carrier's company, equipment, authority, or business decisions.

  • The carrier remains responsible for maintaining active authority, insurance, and compliance.
  • The carrier is responsible for accepting or rejecting loads.
  • The carrier is responsible for safe and legal operation of all equipment.
  • HAMBY United will communicate load options and assist with dispatch-related needs.

Non-Solicitation & Protection of Customer Base

Carrier acknowledges that HAMBY United may develop and provide valuable business relationships with shippers, receivers, brokers, and other customers. Therefore, the carrier agrees not to directly or indirectly solicit, communicate with, or perform services for any HAMBY United-provided customer during this agreement and for two (2) years after termination, unless approved in writing by HAMBY United.

Carrier also agrees not to share, disclose, or transfer HAMBY United-provided customer information to any outside party.

If the carrier directly works with a HAMBY United-provided customer without approval, the carrier must pay HAMBY United 10% of all revenue earned from that customer, payable within 10 days of each violation.

Arbitration

Any dispute related to this agreement will be resolved through binding arbitration in the State of Alabama.

Section 07

Limited Power of Attorney

The carrier grants HAMBY United a Limited Power of Attorney for the sole and limited purpose of performing dispatch and administrative tasks on the carrier's behalf, including:

  • Communicating with brokers and shippers regarding available loads.
  • Negotiating and confirming rates the carrier has approved.
  • Receiving and forwarding rate confirmations and load paperwork.
  • Submitting paperwork required to book and dispatch approved loads.

This Limited Power of Attorney does not authorize HAMBY United to take ownership of the carrier's authority, equipment, or business, to bind the carrier to any load without approval, or to access the carrier's funds. It is limited strictly to dispatch support and is revocable by the carrier at any time in writing.

After submitting, HAMBY United will receive your completed agreement, your uploaded documents, your signature image, the date signed, and your unique signature ID. A copy will also be emailed to you.

Agreement approval may be delayed until all required documents are received.
